other than those on railway service, payments received by the Railway on account of such telegrams shall be di- vided between the two Sections opfair and equitable terms

to be hereafter agreed upon.

Fares and Rates

Each Section shall periodically hand to the other its local fare and rate schedules with lists of the through faresand rates prepared and agreed upon by the administra- tions of the two Sections: all such schedules shall be drawn up in the English and Chinese language and in Hongkong Our- rency and Chinese Currency and posted conspicuously at each Station. Unless with the agreement of His Excellency the Vice- roy of Canton and His Excellency the Governor of Hongkong no alteration in any "intermediate" fare or rate shall be made

by either Section without giving at least one month's previous notice in writing to the other, and no alteration in any through fare or rate shall be made without the consent of the administra- tion of the other Section: all such through fares and rates shall be fixed with a view to enabling the two Sections suc- cessfully to compete as far as possible with waterborne traffic.

Pending further calculations based on actual results to be made after fifteen months through working the through fares and rates specified in Schedules B and hereto attabhed shall be charged by each Section from the date of the opening of the

Chinese Section.

After fifteen months actual working the through fares and rates shall be adjusted by a conference of duly authorised re- presentatives of each Section to be held in the sixteenth month.

The basis of the adjustment shall be such that the ratio of the net earninge of each Section from through traffic to the capital cost of construction of that Section shall be as nearly as possible identical in respect of every description of through

traffic.
